A Private Note to Our Members The SCHOOLS PLUS CCU is committed to making available financial products and services that will enable you to meet your financial needs and reach your financial goals. Protecting personal information and using it in a manner consistent with your expectations is a high priority for everyone associated with our Credit Union. As a member of the SCHOOLS PLUS CCU, you also have a responsibility to safeguard your financial information. To ensure that you can rely upon the quality of products and services we make available, your Credit Union stands behind the following privacy policy: Your Credit Union will collect only the personal information that is necessary to conduct our business. That means just what is necessary to provide competitive financial products and services -- no more. . Your Credit Union will protect your personal information. Your Credit Union will maintain strong security controls to ensure that member information in our files and computers is protected. Where appropriate, we will use security-coding techniques to protect against unauthorized access to personal records, ensure accuracy and integrity of communications and transactions, and protect member confidentiality. . You will always have access to your information. As a member of the SCHOOLS PLUS CCU, you will always have the opportunity to review your information and make necessary changes to ensure that our records are complete and accurate. . Your Credit Union will only share information when absolutely necessary. We will only share information to administer the products and services we provide, when required to do so by the government, or when we partner with other businesses to offer a broader array of products and services . Your Credit Union will partner only with businesses that follow strict confidentiality requirements. The business we select will offer products designed to enhance our members' economic well being. Under no circumstances will we authorize these firms to charge your account without your express consent, and we will not sell member information to telemarketing firms. . Example of our partners: Liberty Checks to print your personal checks. CUNA mutual to provide your credit life or disability insurances or to offer you their term life products, the school district or your employer to provide payroll deductions, or Credit Union Center to provide home mortgages. . Your Credit Union offers you a choice in how your information is used. Any member of our Credit Union may elect to keep their information from being shared with our business partners. We will take all reasonable steps to make sure your requests are followed. At least once a year, we will send a privacy notice to all members. Release of Information Policy It is the policy of the SCHOOLS PLUS CCU to protect both personal and financial information about our members. All documents no longer required to be maintained, and which contain any personal or financial information about the credit union or its members, must be shredded. It is the policy of this credit union to refuse to share personal information about our members, with only a few exceptions: We will provide loan payment history information to credit reporting services. We will provide loan payment history information to another credit union if, in the opinion of management, this information is substantially the same as in item (a) above, and when the identity of the requesting party is clearly known. We will verify funds to third parties, as this is in the interest of our members (although actual balances are never provided) Police, lawyers, and other persons or agencies which seem to have a legal claim to information will generally not be provided with this information without a written order and/or authorization from our attorney. If the point is unclear, permission should be obtained from management. Verification of deposit requests from another financial institution will be released only with signed member authorization. Payoff figures to third parties will be released only with member authorization. Account balance information will be released only to a person named on the account as owner or joint owner. We will not release this information to anyone else, no matter how closely related to the member, without prior authorization from the member to do so.   Terms of Use The SCHOOLS PLUS CCU Web Site is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein. Your use of the SCHOOLS PLUS CCU Web Site constitutes your agreement to all such terms, conditions, and notices. YOU SPECIFICALLY AGREE THAT SCHOOLS PLUS CCU IS NOT RESPONSIBLE OR LIABLE FOR ANY THREATENING, DEFAMATORY, OBSCENE, OFFENSIVE OR ILLEGAL CONTENT OR CONDUCT OF ANY OTHER PARTY OR ANY INFRINGEMENT OF ANOTHER'S RIGHTS, INCLUDING INTELLECTUAL PROPERTY RIGHTS. YOU SPECIFICALLY AGREE THAT SCHOOLS PLUS CCU IS NOT RESPONSIBLE FOR ANY CONTENT SENT USING AND/OR INCLUDED IN AN SCHOOLS PLUS CCU SITE/SERVICE BY ANY THIRD PARTY. IN NO EVENT SHALL SCHOOLS PLUS CCU AND/OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SCHOOLS PLUS CCU SITE/SERVICES, WITH THE DELAY OR INABILITY TO USE THE SCHOOLS PLUS CCU SITES/SERVICES OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE SCHOOLS PLUS CCU SITE/SERVICES, OR OTHERWISE ARISING OUT OF THE USE OF THE SCHOOLS PLUS CCU SITE/SERVICES, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF SCHOOLS PLUS CCU OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SCHOOLS PLUS CCU SITES/SERVICES, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SCHOOLS PLUS CCU SITE/SERVICES. SCHOOLS PLUS CCU may also terminate or suspend your access to SCHOOLS PLUS CCU Site/Service(s) for inactivity, which is defined as failing to log into a particular service for an extended period of time, as determined by SCHOOLS PLUS CCU. The amount of time that SCHOOLS PLUS CCU currently considers as an "extended" period of time may be viewed in the FAQ relating to the particular service. Upon termination of the SCHOOLS PLUS CCU Site/Service, your right to use the SCHOOLS PLUS CCU Site/Service immediately ceases. Language It is the express will of the parties that this agreement and all related documents have been drawn up in English. General This agreement is governed by the laws of the State of CU State, U.S.A. Use of the SCHOOLS PLUS CCU Site/Services is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph. You agree that no joint venture, partnership, employment, or agency relationship exists between you and SCHOOLS PLUS CCU as a result of this agreement or use of the SCHOOLS PLUS CCU Site/Services. You agree to indemnify and hold SCHOOLS PLUS CCU, its parents, subsidiaries, affiliates, officers and employees, harmless from any claim, demand, or damage, including reasonable attorneys' fees, asserted by any third party due to or arising out of your use of or conduct on the SCHOOLS PLUS CCU Site/Services. SCHOOLS PLUS CCU's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of SCHOOLS PLUS CCU's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the SCHOOLS PLUS CCU Site/Services or information provided to or gathered by SCHOOLS PLUS CCU with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed supers eded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and SCHOOLS PLUS CCU with respect to the SCHOOLS PLUS CCU Site/Services and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and SCHOOLS PLUS CCU with respect to the SCHOOLS PLUS CCU Site/Services. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. Any rights not expressly granted herein are reserved.
